By accessing or bidding on any auction sales conducted by BidonitLive International (“BLI”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms may be modified at any time and will be effective upon posting such modified version.

  • Bidding.

All bids are final, irrevocable and binding, even if submitted in error. By submitting a bid, you agree that you are entering into a legally binding contract according to the terms and conditions herein when you have the winning bid. You will be the winning bidder if there is no higher bid accepted and if any reserve or reduced reserve on the lot is exceeded by the bid. The winning bidder is contractually obligated to pay the total purchase price, comprised of (a) the bid price, (b) buyer’s premium (as specified below), and (c) any applicable shipping fees and/or taxes set forth in an invoice. Payment is due according to the terms of payment set forth herein. International buyers are solely responsible for any applicable import/export customs duties or taxes. In addition, the winning bidder assumes full risk and responsibility for the lot on the fall of the auctioneer’s hammer.

It is a criminal offence to place a bid and not pay for the item you have bid on. Please make sure you are bidding on correct items.

For all residents of California or shipments to California applicable sales tax will be added to your invoice. All purchases purchasing pursuant to a valid resale license will need to provide appropriate documentation for removal of state sales tax and it must be in the Jewelry business.

Shipping fees will all depend on value and where purchase is being shipped. You the Buyer responsible for all shipping and taxes and duties.

All shipments will be insured and included in shipping price.

All domestic packages within the USA are shipped within 10-14 business days. International shipping can vary 12-16 business days. Shipping fees will be included in your invoice.

All shipping for ARTWORK will have TBD all depending on where it is being shipped to and from as some artwork will come direct from artists.

Framing : Most work is sold unframed. We can do framing for an additional cost. Please contact us at steven@bidonitlive.com to inquire about if a piece is framed and if not what the costs would be.

All statements provided by BLI regarding the available lots are qualified statements of opinions, and not a representation, warrantee or guarantee of any kind. Further, while BLI attempts to catalogue every lot correctly and will attempt to point out any defects, BLI will not be responsible or liable for the correctness of the catalogue or other descriptions of the lot. All items are available for inquiries prior to bidding. Any appraisals, estimates or evaluations are solely informational relating to gemstone, Diamonds and/or metals weight, size, and grade only, and cannot be relied upon as a lot’s actual resale value, insurance replacement value, or cost of a similar good.

All Artwork has been verified and authenticated to be original, either from the Artist or from the Art dealer. Artwork may also be prints, lithograph, serigraphs, will all be noted at time of sale.

  • Payment

All sales final. Returns or exchanges will not be accepted for any reason. Payment is due immediately after receipt of invoice.

You will not own the lot until BLI has received full, clear, and undisputed payment of all amounts due, even in circumstances where we have released the lot to you. If you do not pay when payment is due, in addition to all other remedies available to us by law, we may at our election: (a) impose a late charge of 1.5% per month on all amounts due, (b) hold you liable for the total purchase price and commence legal proceedings to recover the amount owed plus the costs associated with such proceedings, (c) cancel the sale, retaining all payments made by you as liquidated damages, and/or b) cancel the sale and resell the purchased property at public or private auction with or without reserve, and the you will be liable for any deficiency costs. BLI, or any collection agencies we may retain, may also report information about your default to credit agencies, which in turn may be reflected in your credit report.

ALL INTERNATIONAL DUTIES AND INTERNATIONAL TAXES ARE THE RESPONSIBILITY OF THE BUYER. For all items purchased online you will be emailed an invoice within 30 minutes after the auction (please check your spam folder if not in your inbox).   • Auctioneer’s Discretion.

BLI reserves the right in its sole and absolute discretion at any time prior to, during, or after the close of the auction to exclude any bidder, to reject any bid, and to award any lot to the highest accepted bid. BLI reserves the right to withdraw any lot at any time before, during, or after the auction without liability. BLI reserves the right to divide any lot or combine any two or more lots. BLI has absolute and sole discretion in case of error or dispute with respect to bidding and BLI’s decision as to the winning bidder shall be final and binding.

  • Reserves

In the event that any reserve price of a lot is not exceeded by any bidder’s bid, BLI, in its sole discretion, with or without the knowledge of or notice to any bidder, may reduce any reserve price to an amount below the bid of bidder at any time during an auction and accept the bid made by bidder. On lots with a reserve, BLI shall have the right to bid on behalf of the seller. Reserve prices are always the confidential and will not be disclosed to bidders unless specifically stated as such during bidding. Nothing contained in any listing shall be construed to disclose any reserve price.

  • Limitation of Liability

To the maximum extent permitted by law, BLI is not liable, and you agree not to hold us responsible, for any special, indirect, incidental or consequential damages (including for loss of profits or revenue, costs of obtaining alternative property, claims of customers of buyer or otherwise) resulting from or relating to your purchase or participation in an BLI auction or the acts or omissions of BLI relating to the purchase, sale or delivery of goods from an BLI auction. Further, our total liability to you or any third party is limited to the purchase price paid by you to BLI.

  • Law and Disputes

This agreement, and any non-contractual obligations arising out of or in connection with this agreement, or any other rights you may have relating to the purchase of a lot will be governed by the laws of California. Before we or you start any court proceedings (except in the limited circumstances where the dispute, controversy or claim is related to proceedings brought by someone else and this dispute could be joined to those proceedings), we agree we will each try to settle the dispute by mediation submitted to JAMS, or its successor, for mediation in San Diego, California. If the dispute is not settled by mediation within 60 days from the date when mediation is initiated, then the dispute shall be submitted to JAMS, or its successor, for final and binding arbitration in accordance with its Comprehensive Arbitration Rules and Procedures or, if the Dispute involves a non-U.S. party, the JAMS International Arbitration Rules. The arbitration shall be conducted by one arbitrator, who shall be appointed within 30 days after the initiation of the arbitration. The language used in the arbitral proceedings shall be English. The arbitrator shall order the production of documents only upon a showing that such documents are relevant and material to the outcome of the Dispute. The arbitration shall be confidential, except to the extent necessary to enforce a judgment or where disclosure is required by law. The arbitration award shall be final and binding on all parties involved. Judgment upon the award may be entered by any court having jurisdiction thereof or having jurisdiction over the relevant party or its assets. This arbitration and any proceedings conducted hereunder shall be governed by Title 9 (Arbitration) of the United States Code and by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards of June 10, 1958.

Complementary 14k or 18k gold setting with each purchase of a Diamond.

Once Diamond has been purchased and paid for you will be able to choose a setting and have given us sizing ( you are responsible for correct sizing) and therefore shipment may take longer as it will have to be sized and set.

ZIRCON

TANZANITE

Poised between lush blue, vibrant violet, and rich purple, exotic tanzanite is found in only one place on earth, near majestic Mount Kilimanjaro.

SUNSTONE

Sunstone, a member of the feldspar group, can be an orthoclase feldspar or a plagioclase feldspar, depending on chemistry. Both can show aventurescence. “Sunstone” applies to the gem’s appearance.

KUNZITE
